Buongiorno a tutti

Chiedo a chi ne sà più di me alcuni consigli.

Sono sposato da un mese con una ragazza moldava.In questi giorni sto contattando l'Ambasciata Italiana in Moldavia per altri motivi e tra le esaurienti spiegazioni mi hanno detto di far trascrivere il mio matrimonio in Moldova.
Il messaggio che l'Ambasciata mi ha mandato è questo:


Buon giorno!
Un cittadino moldavo, ma cio' vale per tutti coloro che contraggono matrimonio all'estero, ha l'obbligo di trascrivere o far trascrivere l'atto di matrimonio presso la Stato Civile del paese di nascita in Moldova.
Per cui bisognera' richiedere il certificato del suo matrimonio presso lo Stato Civile italiano, farlo tradurre ed apostillare (Prefettura) e quindi depositare in Moldova.
Di fatto - ma e' solo una battuta - sua moglie in Moldova non risulta sposata e potrebbe risposarsi tranquillamente, non risultando il matrimonio avvenuto in Italia.

Il certificato deve essere in carta semplice o bollata?
Come faccio a depositarlo in Moldova?

Se vuoi propio fare-fai. Io sono sposata in Italia da tanti anni e non ho fato nessuna trascrizione in Moldavia, non penso che propio neccesario,poi vado 3 volte al anno in Moldavia e nessuno mi ha detto mai niente

guarda tutto è nato quando ho contattato l'ambasciata in Chisinau per sapere come far venire qui mia suocera.
Tra le tanta informazioni fornite mi hanno consigliato di fare questa trascrizione.Io ho pensato di farla solo perchè avevo il timore che servisse più in là quando dovrò presentare i vari documenti
per mia suocera.

Dato che voglio chiamare come familiare al seguito mia suocera ho paura che questa trascrizione possa servire in seguito in quanto sia mia moglie che mia suocera dovranno presentare parecchi documenti

il matrimonio celebrato in Ita è già valido .

La trascrizione in MD serve solo a renderlo valido anche in MD

il matrimonio probabilmente è "valido" anche in Moldova, nel senso che pur non avendone conoscenza vada comunque trascritto, non è opponibile a terzi in quanto non trascritto. In ogni caso in caso di divorzio è interesse del cittadino Moldavo trascriverlo per essere sicuro di non fare pasticci con la propria legge. Immaginate il caso di cittadino moldavo sposato in Italia ma non trascritto che si risposi in Moldova perchè risulta ancora celibe o nubile. In linea teorica potrebbe riuscirci ma probabilmente commette reato.

Inoltre fatto 30 fai 31 anche tu hai diritto ad acquisire i tuoi diritti in Moldova in quanto cittadino coniugato con Moldava,innanzitutto quello a risiedere più di 3 mesi l'anno, che poi (per ora) non te ne freghi niente è un conto, ma chissà un domani. Prenditi la "patente D" puo' sempre tornare utile, segui il consiglio dell'ambasciata e trascrivi il matrimonio in Moldova

Transcription of civil status act goes through 4 stages:

 
Submitting the request: 

The request of civil status act transcription may be submitted to: 
the OCS of which territorial radius you are living; 
the Diplomatic missions and Consular offices of the Republic of Moldova 

 
Request examination: 

OCS/ diplomatic mission (consular office) will examine the application of the required civil status act transcription, will organize the register and send it to the Civil Status Service approval (which lasts 15 working days, without taking into account the mailing time).
Request approval: 

Register examination by the CSS, can be examined on person’s request as an emergency, in case of personal presentations to the Methodical Department and the dossier examination of the Control and methodology Directorate of the Civil Status Service on Mihail Kogalniceanu street, 58A

For an emergent register examination, must be presented the following documents:
sealed register (in the envelope) as established; 
applicant’s identity card; 
proof of authorization (in case of representation): proxy, mandate contract, service ticket that confirms protection authority or other authorized body, etc.; 
payment fee of settled taxes. 

 
Registration of civil status act: 

 

After the dossier approval, the OCS/ diplomatic mission (consular office) will transcribe the required civil status act and will issue the civil status certificate to the applicant.

 
 
Categories of applicants

The following categories of applicnats may request the transcription of civil status certificate:

 
Holder of civil status act or in exceptional cases (argued in writing form) by his first degree relatives; 
Family members, relatives of the deceased or other entitled persons – in case when the holder of civil status act is dead; 
Minor’s legal representative, person restricted in exercise capacity or disable, guardians or curators, representative of the protection authority); 
Representative stipulated by contract (authorized by a warrant, proxy). 
 
Required acts for the transcription 

For the transcription of marriage certificate: 

Required –
1. request regarding the transcription of marriage act (F-40 CT) ; 
2. [MULTILINGUAL] extract from marriage act or certificate, issued by the foreign comptent bodies, legalized and translated; 

**Multilingual extracts from birth, marriage and death acts issued by in the following countries   Germany Luxemburg Slovenia Belgium Netherlands Croatia   Spain Portugal Macedonia  France Switzerland Bosnia and Herzegovina Italy Turkey Serbia  Poland Montenegro    have legal effects without being extra-legalized, authenticated and translated (International Commission Convention of Civil Status nr. 16 signed in Vienna on 08.09.1976)


 3.  document that attests person belonging to the citizenship of Moldova (identity card, passport, notice regarding persons recognition as a citizen of the Republic of Moldova); 
4. payment fee of settled taxes. 

Optional –
husband identity card, foreign citizen; 
husbands birth acts; 
act that proves the dissolution of previous marriage or husbands death act from the previous marriage; 
other acts if these are necessary.

Già oggi ho cominciato a fare i giri.

Ho richiesto un certificato di matrimonio plurilingue come consigliatomi dal Sig. Amedeo che non necessita di traduzione o validazione in prefettura.
